Výkon stavebnej kompetencie bol procesom decentralizácie verejnej správy na Slovensku delegovaný zo štátnych orgánov na obce bez ohľadu na ich veľkosť. Stavebným úradom na Slovensku je podľa súčasného stavebného zákona každá jedna obec. V Českej republike sa stavebným úradom stala obec, ktorá mala na výkon tejto kompetencie predpoklady v zmysle kategorizácie obcí. Stavebná kompetencia je administratívne veľmi náročnou kompetenciu, ktorá si vyžaduje neustálu reflexiu v svojej pôsbnosti. Malé stavebné úrady na Slovensku nezvládajú vykonávať túto kompetenciu – finančne, personálne, materiálno technicky. Stavebné úrady v Česku tiež majú problém s výkonom tejto kompetencie, čo je potrebné riešiť. Na Slovensku ale aj v Česku sa aktuálne rieši otázka prijatia novej legislatívny, ktorá by výkon stavebnej kompetencie zefektivnila. Podľa doposiaľ dostupných informácií však pôjde o dosť zásadné zmeny, protredníctvom ktorých výkon stavebnej komptencie na Slovensku bude spätne transferovaný z obcí na štátne orgány, a v Česku budú kompetencie ponechané aj obciam III. kategórie, aj štátnym orgánom. To či tento krok bude efektívny pre spoločnosť, je doposiaľ otázne.
Abstract (EN): 
The performance of building competence was during the decentralization of public administration in Slovakia transferred from the state bodies to municipalities regardless of their size. According to the current Building Act, every municipality is a building authority in Slovakia. In the Czech Republic, the building office became a municipality that had the prerequisites to exercise this competence in terms of categorization of municipalities. Building competence is an administratively very demanding competence that requires constant reflection in its scope. Small building authorities in Slovakia do not manage to exercise this competence due to financial , personnel, material and technical insufficiency. Building authorities in the Czech Republic also have a problem with the exercise of this competence, which needs to be solved. In Slovakia, but also in the Czech Republic, the issue of adopting a new legislation, which would make the exercise of construction competence more efficient, is currently being addressed. According to the information available so far, however, these will be quite fundamental changes, through which the performance of construction competence in Slovakia will be transferred back from municipalities to state authorities, and in the Czech Republic the competencies will be left to municipalities of IIIrd. category, as well as to public authorities. Whether this step will be effective for the society, is still questionable.
